King George speaks for first time since independence declared

"On this day in 1776, in his first speech before British Parliament since the leaders of the American Revolution came together to sign of the Declaration of Independence that summer, King George III acknowledges that all was not going well for Britain in the war with the United States.

In his address, the king spoke about the signing of the U.S. Declaration of Independence and the revolutionary leaders who signed it, saying, "for daring and desperate is the spirit of those leaders, whose object has always been dominion and power, that they have now openly renounced all allegiance to the crown, and all political connection with this country." The king went on to inform Parliament of the successful British victory over General George Washington and the Continental Army at the Battle of Long Island on August 27, 1776, but warned them that, "notwithstanding the fair prospect, it was necessary to prepare for another campaign."

Despite George III's harsh words, General William Howe and his brother, Admiral Richard Howe, still hoped to convince the Americans to rejoin the British empire in the wake of the colonists' humiliating defeat at the Battle of Long Island. The British could easily have prevented Washington's retreat from Long Island and captured most of the Patriot officer corps, including the commander in chief. However, instead of forcing the former colonies into submission by executing Washington and his officers as traitors, the Howe brothers let them go with the hope of swaying Patriot opinion towards a return to the mother country.

The Howe brothers' attempts at negotiation failed, and the War for Independence dragged on for another four years, until the formal surrender of the British to the Americans on October 19, 1781, after the Battle of Yorktown."

The East Pediment and West Facade

At the rear of the Supreme Court Building is the East Pediment, one which is sadly missed by many visitors. Like so much of the carving around the building, it s beautifully done and worthy of a look for its artistic merit alone. But much of the carving is allegory, so that too is worthy of our attention. 

In the center of the East Pediment is a large figure holding two tables. It is Moses, and the tables are the Ten Commandments. He is flanked by Solon and Confucius because they represent the law we inherited from former civilizations. They are surrounded by figures representing the enforcing of the law, the settlement of disputes, maritime law, study and pondering of judgments, along with the tortoise and the hare. But central to the arrangement is Moses and the Ten Commandments.

On the west facade, the front side, also features a pediment with allegorical figures though these have the faces of historic Americans such as Taft and John Marshall as well as people involved in the construction of the building. But the facades of the building also has eight medallions which adorn the corners of the building. The two on the west facade represent lawgivers. These two are Hammurabi and Moses.

One of the most exquisite features of the Supreme Court Building is the frieze which encircles the ceiling of their chamber. These are carved in bas relief which means the figures are carved so they stand out from the background but are not free standing. They are shallow carvings but done in such a way that the figures are not distorted when viewed from any angle.

The East frieze is the one directly above the judges bench and represents the Majesty of the Law and the Power of Government. Facing the justices is the West frieze which is an allegorical representation of the ongoing fight between good and evil.

The North and South friezes run along the sides of the chamber and feature the great law givers arranged chronologically from Menes of ancient Egypt to Napoleon of 19th century France. Interspersed among the carvings of actual historical figures are more allegorical ones including History, Philosophy, and the Right of Man. Just to the left of the figure of Authority is Moses. In his hand he holds the two tables of the Ten Commandments though one is on top of the other. Visible are commandments six through ten because they relate to human relationships and the law. The tablets are shown in the same style as throughout the rest of the building, which arched tops. This is a feature which differentiates them from depictions of the Bill of Rights which also number ten.

Lining the sides of the Great Hall of the Supreme Court Building are busts of the Chief Justices of the Supreme Court. While these are not religious symbols, these were religious men.

The first Chief Justice was John Jay of New York. Jay was an Episcopalian. Of his faith he said:

"The Bible is the best of all books, for it is the word of God and teaches us the way to be happy in this world and in the next. Continue therefore to read it and to regulate your life by its precepts."

The second Chief Justice was John Rutledge of South Carolina. Rutledge was also Episcopalian/Anglican. He stated:

The third Chief Justice was Oliver Ellsworth of Connecticut. He was a Congregationalist. He said:

"Some very worthy persons, who have not had great advantages for information, have objected against that clause in the constitution which provides, that no religious test shall ever be required as a qualification to any office or public trust under the United States. They have been afraid that this clause is unfavorable to religion. But my countrymen, the sole purpose and effect of it is to exclude persecution, and to secure to you the important right of religious liberty. We are almost the only people in the world, who have a full enjoyment of this important right of human nature. In our country every man has a right to worship God in that way which is most agreeable to his conscience. If he be a good and peaceable person he is liable to no penalties or incapacities on account of his religious sentiments; or in other words, he is no subject to persecution."

Around the country atheist groups have demanded that depictions of the Ten Commandments be removed from courthouses and other public spaces. They claim these monuments violate the First Amendment, that they establish a religion and interfere with the free exercise. We are at a loss how. To date there is no national religion. We are a Christian country in our history and our heritage. We are a Christian country in the most common faith of our people. But we do not have a state church. Furthermore, how can a monument interfere with the free exercise? It does not create a compulsory attendance law forcing people to go to church. It does nothing but sit there. It cannot even force one to look at it.

One also must wonder what religion the Ten Commandments create. These ten laws were given to the ancient Hebrews and yet no one claims the United States is a Jewish country. They are part of the Bible which is the holy book of Christianity, but then which denomination do they set up? Catholic? Eastern Orthodox? Coptic? Episcopalian? Presbyterian? Methodist? Baptist? Mennonite? Islam too acknowledges all but the Fourth Commandment. Therefore, which religion? For if a religion is set up, it must be a specific one. If it is general, then it is not established.

These are some reasons why such claims are false. But let us consider another thing. If such religious monuments are truly unconstitutional, then surely one would not find them in the very halls of our Supreme Court, the highest court in the land! And yet they are there. This image was taken by the host of the page on a visit to Washington, D.C. It is on the lower panel of both doors leading into the courts own chambers where the justices meet. And it is not the only image of the Ten Commandments. Another can be found in the frieze around the ceiling. A third is in one of the metopes of the Great Hall. A metope is a square space between triglyphs in a Doric frieze. There are also tablets carved into the frames of the Courtrooms' bronze gates. So if it is okay for the Supreme Court, why is it not for the rest of America?

CHATTANOOGA, Tenn. – U.S. Senator Bob Corker (R-Tenn.) today released the following statement ahead of Affordable Care Act open enrollment, which begins November 1.
“The Affordable Care Act was sold to the American people as a way to bring down health care costs and provide certainty to individuals and companies across our country,” said Corker. “Unfortunately, the reality Tennesseans will face as open enrollment begins next week is far different. In our state alone, many individuals will face 44 to 62 percent price increases, and with the leading insurer recently exiting three metro areas due to losses and uncertainty in the marketplace, families will have far fewer choices. These consequences are part of the reason I strongly opposed passage of the law. Our challenge now is to come together around a responsible solution that will alleviate the negative effects this law has had across our country and ensure that Tennesseans have access to affordable and quality health care.”  
Corker strongly opposed passage of the Affordable Care Act and has supported legislation to repeal it.

If the 26th Amendment had one of the shortest periods of ratification, the 27th had by far the longest. It took almost 203 years or 74,003 days.

The 27th was one of the original amendments to the Constitution proposed by James Madison to the first Congress and sent out to be ratified by the states. Ten of these 12 amendments were ratified in 1791. But this one lingered.

In his speech to the House of Representatives Madison made this the third item in his list,

“Thirdly, That in article 1st, section 6, clause 1, there be added to the end of the first sentence, these words, to wit: ‘But no law varying the compensation last ascertained shall operate before the next ensuing election of Representatives.’"

The amendment failed to get the number of states needed for ratification. There is nothing in Article 5 declaring the fate of amendments not ratified, so this one entered what seemed to be a state of perpetual uncertainty and neglect for 80 years before Ohio chose to ratify it as a protest against congressional pay raises. That was followed by a century more of disregard before its cause was once again resurrected in 1978 by Wyoming. When no other states choose to follow the state’s lead, it seemed that the fate of this amendment was to exist forever in limbo. But then an aide to a legislator in Texas took up its cause. Over the next five years a sufficient number of states ratified the amendment to finally make Madison’s vision a part of the Constitution, proving it is never too late to fulfill the visions of our Founding Fathers.

The 27th Amendment:

“No law, varying the compensation for the services of the Senators and Representatives, shall take effect, until an election of Representatives shall have intervened.”

Amendment 26 – Voting Age Set at 18

One of the shorter amendments to the Constitution, the 26th sets the minimum voting age for all citizens to 18 years of age.

History is once again the reason for the amendment. In the 1970s the United States was in the midst of the Vietnam War. Young men were being sent off to fight, men as young as 18 years old. It seemed an odd thing to send, or in fact force, young men to fight for their country but not allow them to have a say in the running of it. The typical voting age at that time was 21.

Congress initially tried to reconcile this through an extension of the Voting Rights Act, but some states objected to the change. Eventually the issue made it to the Supreme Court which ruled that Congress had the authority to set the age for national elections but not for state and local ones. It was a moot point. The amendment passed just a few months after the ruling; only 100 days after Congress approved it, one of the shortest ratification periods for any amendment.

Jury Convicts NC Superior Court Judge Arnold O. Jones, II On All Corruption Charges

WILMINGTON – The United States Attorney’s Office announced that today in federal court, the jury returned a verdict of guilty on all three corruption charges pending against the defendant, North Carolina Superior Court Judge ARNOLD OGDEN JONES, II.  The defendant was charged in a Superseding Indictment with Paying Bribes; Paying Gratuities; and Attempted Corrupt Influence of an Official Proceeding. 
Following a five-day trial, the jury began deliberations at 10:02 am, and returned a verdict at 10:35 am.  Sentencing of the defendant will occur during the court’s January 23, 2017 term.
United States Attorney John Stuart Bruce stated, “The jury’s verdict affirms a bedrock principle of the rule of law.  No person holding a postion of public trust in our legal system is permitted to subvert that system for his own personal objectives.”
"Corruption will not be tolerated, no matter the level of government, the complexity of the scheme, or the names of those committing the fraud.  Rooting out public corruption is the FBI’s top criminal investigative priority and we rely on our law enforcement partners and citizens to help us identify those offenders who put our democracy at risk," said John Strong, Special Agent in Charge of the FBI in North Carolina.
During the trial, the evidence established that between October 10, 2015 and November 3, 2015 JONESgave, offered, and promised cases of beer and $100 to a Federal Bureau of Investigation Task Force Officer to influence him to compel Verizon to produce JONES’s wife’s text messages, and to disclose those messages to JONES, even though he was not permitted to receive them by law.  Upon being contacted by JONES, the Task Force Officer quickly reported it and, with FBI supervisory approval, a FBI investigation was initiated.  Evidence at the trial established that JONES, as a judge, was familiar with the processes and procedures law enforcement must undertake to obtain private text message content, including the need for the FBI to have an ongoing investigation and a legitimate law enforcement need for such text content.  The evidence further established that JONES desired the text messages to investigate his suspicions that his wife was having an affair.  Evidence presented at trial, including multiple recorded conversations, established JONES’s desire to conceal the FBI Task Force Officer’s involvement in obtaining the texts.  JONES agreed to destroy evidence of the crime, including a disk purported to contain the text messages, and text messages coordinating the exchange of cash and a disk.  The evidence in the case concluded with a video of JONES exchanging the cash and disk on the steps of the Wayne County Courthouse in his judicial robe.
     At sentencing, on the charge of Bribery, the defendant faces not more than 15 years in prison and up to $250,000 in fines.  On the charge of Gratuities, the defendant faces not more than 2 years in prison and up to $250,000 in fines.  On the charge of Attempting to Corruptly Influence an Official Proceeding, the defendant faces not more than 20 years in prison and a fine of up to $250,000. 
Investigation of this case was conducted by the Federal Bureau of Investigation.  Assistant United States Attorneys William M. Gilmore and Adam F. Hulbig prosecuted the case on behalf of the government.

Seminole County Man Pleads Guilty To Sex Trafficking Of A Minor

Orlando, Florida – United States Attorney A. Lee Bentley, III announces that Rowy De Jesus Vasquez (26, Altamonte Springs) today pleaded guilty to sex trafficking of a minor. He faces a penalty of 10 years, up to life, in federal prison. Vasquez was indicted on December 9, 2015.
According to the plea agreement, between April 24, 2015, and June 10, 2015, Vasquez caused a 14-year-old girl to engage in commercial sex acts for his financial gain and profit. He provided the girl with a cellphone to communicate with potential customers and to post advertisements for prostitution services on the Backpage website. Vasquez also set the prices for the sex acts and kept all of the proceeds.
This case was investigated by the Federal Bureau of Investigation, with assistance from the Metropolitan Bureau of Investigation. It is being prosecuted by Assistant United States Attorney Ilianys Rivera Miranda.
This case was brought as part of Project Safe Childhood, a nationwide initiative launched in May 2006 by the Department of Justice to combat the growing epidemic of child sexual exploitation and abuse. Led by United States Attorneys' Offices and the Criminal Division's Child Exploitation and Obscenity Section (CEOS), Project Safe Childhood marshals federal, state, and local resources to locate, apprehend, and prosecute individuals who sexually exploit children, and to identify and rescue victims.  For more information about Project Safe Childhood, please visit www.justice.gov/psc.
