Sen. Rand Paul Uncovers $1.4 Million Wasteful EPA Early Retirement Buyout for Employees

WASHINGTON, D.C. – U.S. Senator Rand Paul today released the latest edition of ‘The Waste Report,’ which is an ongoing project cataloguing egregious examples of waste within the U.S. government.
In the latest edition of ‘The Waste Report,’ Sen. Paul uncovers the Environmental Protection Agency (EPA) spending nearly $12 million on early retirements buyouts for roughly 500 employees to allegedly modernize their workforce. However, of the 500 vacated positions, 12% were not eliminated and refilled without being changed – costing the taxpayers $1.4 million.

Somewhere along the line you have probably heard of early retirement buyouts, where a company offers employees a sum of cash and an early retirement. Often used as an alternative to layoffs, the idea is to get more senior, and thus more expensive, employees off the payroll and then eliminate or restructure their jobs to be less costly. A good deal all around...that is unless you are a taxpayer and the Environmental Protection Agency (EPA) is offering early buyouts.

According to the EPA Inspector General, in the Fiscal Year 2014, the EPA paid out nearly $12 million on early buyouts for roughly 500 employees.However, a sampling done by the Inspector General showed that roughly 12% of the vacated positions were not eliminated and were refilled without being changed.[1] If this is a representative sample of all EPA buyout, the taxpayer would have unnecessarily spent $1.4 million. 

In authorizing agencies to offer early buyouts, Office of Personnel Management (OPM) expressly says the position being vacated must either be eliminated or modified:
(1) having a different job series and/or grade, (2) using the same job series and grade but substantively different duties and responsibilities, (3) having a different full-performance level, or (4) that is no longer supervisory.”[2] 

That’s not a really high bar, and since the whole point of buyouts is to streamline the workforce, what got missed? Even the EPA agreed with the finding saying, “we understand how the IG drew their conclusion.”[3] They noted the new hires were budget neutral, meaning they did not cost any more than the people they replaced, but the taxpayer is still out the buyout money.  

It is not surprising the EPA looked to early buyouts to modernize their workforce and hopefully save the taxpayer in the process. The federal government is notorious for its job security; many believe to a fault. Less than one half of one percent of federal employees were terminated for performance or laid off last year. The EPA is even worse, only 15 employees or one tenth of one percent were terminated for performance; that is slightly more than the 13 EPA employees who died last year.[4]    

They say you have to spend money to make money. Apparently at the EPA, you just have to spend money.

Earlier this month, Judicial Watch asked a federal court for permission to depose Hillary Clinton in one of two ongoing lawsuits involving her private server. Thursday afternoon the Department of Justice weighed in on the side of the State Department, saying Judicial Watch’s request was too broad and would duplicate effort already underway in another case. In the government’s filing late Thursday, the Justice Department said that Judicial Watch’s request is “overbroad and duplicative.”
Instead, it claimed, the group should complete the depositions in the other case first before demanding an interview of Clinton and the other officials.
However, the department did say that it would not oppose a request to subpoena Jake Sullivan, a former senior State Department official and current top aide in Clinton’s presidential campaign, as long as questions were “on the limited topic” of officials using personal email accounts at the department.

Freedom of Speech is Vital!

I am presenting this meme, not because I agree with it, but because I do not agree with it.

There is a reason that Freedom of Speech is presented in the First Amendment. Free Speech is arguably the most important of the freedoms that we are guaranteed as Americans.

In order for truth to emerge, ideas need to be presented freely in the marketplace of ideas. Then, through discussion and debate, the best ideas rise to the top. And the worst ones sink to the bottom.

Up until recently, Americans have understood this. But now, certain groups have presented a concept called hate speech. What is hate speech? There is no precise definition.

Apparently, certain groups find it easier to suppress ideas that they don't like than to go to the trouble of developing well-reasoned arguments against them. Just call those disliked ideas hate speech and ban them. So much easier.

Bypassing the First Amendment must not be permitted. It is crucial that all ideas, good and bad, have opportunity to be presented. The best disinfectant is light.

I was listening to a video and heard a story about a university that was considering a ban on hate speech. A gay student rose up to object. He said that if the ban went into effect, then students would not be able to truly express what they were feeling. And as a gay man, he was very interested in knowing who was out to get him; that is, who he should keep an eye on.

In Germany, the fact that the established parties are out of touch gave rise to the Alternative for Germany (AfD) party.

In the United States, there is the feeling that both parties have their Establishment and that there is not a lot of difference between the two parties because the Establishment Democrats and Republicans think about the same. Enter Donald Trump and Bernie Sanders. Donald Trump has beaten the Establishment Republicans and Bernie Sanders may yet beat the Establishment Democrat.

Dem Bruch von Recht und Gesetz, der Zerstörung des Rechtsstaats und verantwortungslosem politischen Handeln gegen die Prinzipien wirtschaftlicher Vernunft konnten und wollten wir nicht länger tatenlos zusehen. Ebenso wollten wir nicht länger hinnehmen, dass durch das Regime der EURO-Rettung längst überwundene Vorurteile und Feindseligkeiten zwischen den europäischen Völkern neu aufbrechen. Daher haben wir uns dafür entschieden, Deutschland und seinen Bürgern in allen Bereichen eine echte politische Alternative zu bieten.

Als freie Bürger treten wir ein für direkte Demokratie, Gewaltenteilung und Rechtsstaatlichkeit, soziale Marktwirtschaft, Subsidiarität, Föderalismus, Familie und die gelebte Tradition der deutschen Kultur. Denn Demokratie und Freiheit stehen auf dem Fundament gemeinsamer kultureller Werte und historischer Erinnerungen. In der Tradition der beiden Revolutionen von 1848 und 1989 artikulieren wir mit unserem bürgerlichen Protest den Willen, die nationale Einheit in Freiheit zu vollenden und ein Europa souveräner demokratischer Staaten zu schaffen, die einander in Frieden, Selbstbestimmung und guter Nachbarschaft verbunden sind.

Atchinson Man Pleads Guilty To Kidnapping, Killing 5-Year-Old Girl

KANSAS CITY, KAN. – An Atchison man pleaded guilty Thursday to federal charges of kidnapping and killing a 5-year-old girl. The charges carry a penalty of life in prison, Acting U.S. Attorney Tom Beall and Leavenworth County Attorney Todd Thompson said.
Marcas McGowan, 32, Atchison, Kan., pleaded guilty to one count of kidnapping resulting in death, and one count of discharging a firearm during a crime of violence. In his plea, he admitted that on July 18, 2014, he shot and killed the girl after he kidnapped her and exchanged gunfire with police.
The incident began with a domestic dispute between McGowan and his girlfriend, Christina Harris, the mother of the 5-year-old victim. During the argument McGowan threatened Harris with a gun and she called 911. McGowan put Harris’ daughter in his car and drove away as police arrived.
Police pursued McGowan as he drove through downtown Atchison, across the river into Missouri and then back to Leavenworth, Kan., at speeds up to 95 miles an hour. While fleeing from law enforcement, McGowan fired his gun at the officers. On a highway near the northwest corner of Leavenworth he crashed through a barricade and stopped the car. When he got out of the car, he ignored police orders to drop the weapon. The officers returned fire and shot McGowan, who eventually stopped pointing his gun at the officers.
In the car, police found the girl dead from a gunshot wound. Forensic evidence revealed McGowan had shot her at close range with a 9 mm handgun while she was in the car.
Sentencing is set for Sept. 6. Both parties have agreed to recommend a sentence of life on the kidnapping charge, which is the statutory minimum penalty. The firearm count requires a statutory minimum penalty of 10 years consecutive to the other sentence.
Leavenworth County Attorney Todd Thompson was appointed as a Special Assistant U.S. Attorney for the purpose of the federal prosecution. Beall commended Thompson, the Atchison Police Department, the Platte County (Mo.) Sheriff’s Office, the Weston (Mo.) Police Department, the Leavenworth Police Department, the Kansas Bureau of Investigation, the FBI, and Assistant U.S. Attorney Scott Rask for their work on the case.

Former Federal Employee Pleads Guilty to Using Stolen Money Order Receipts in Fraud Scheme

KANSAS CITY, Mo. – Tammy Dickinson, United States Attorney for the Western District of Missouri, announced that a former federal employee pleaded guilty in federal court today to using stolen money order receipts in a fraud scheme to avoid paying his medical bills.

Byron G. Gorman, 51, of St. Joseph, Mo., pleaded guilty before U.S. District Judge Dean Whipple to the charge contained in a Sept. 10, 2015, federal indictment.

Gorman was employed as an information technology specialist for the U.S. Department of Agriculture's Office of Inspector General, assigned to the Heart of America Regional Computer Forensics Laboratory in Kansas City, Mo., where he was being trained to become a computer forensic examiner.

By pleading guilty today, Gorman admitted that he used stolen money order receipts – taken by Gorman as he participated in a criminal investigation – as fraudulent evidence in court, both to defend himself against a lawsuit against him by his creditors and in his own lawsuit against his creditors.

Gorman was a defendant in a civil collection lawsuit in Buchanan County, Mo., in which a judgment had been entered against him and a garnishment of his wages had been ordered to recover monies owed on medical bills incurred at the Heartland Regional Medical Center in St. Joseph. On Sept. 28, 2012, Gorman’s creditors filed a second civil collection lawsuit against him in Buchanan County to recover monies owed on additional unpaid medical bills.

On May 22, 2012, Gorman participated in the execution of a federal search warrant at the offices of a private business in Kansas City, Kan. Gorman was there to search for computer-related evidence. He found and took five blank U.S. Postal Service money order receipts belonging to the private business and used them to facilitate the scheme to defraud Heartland Regional Medical Center.

Gorman used the stolen money order receipts and other fraudulent documents created as evidence in his defense. Gorman claimed that he had submitted postal money orders to his creditors, but the payments had not posted. As evidence, he provided the five stolen money order receipts, which were filled out to make it appear that money orders had been made out to Heartland Regional Medical Center, as well as a number of forged letters displaying the names and purported signatures of postal employees.

Gorman also used the stolen money order receipts and other fraudulent documents he created as evidence in a lawsuit he caused to be filed against his creditors. Gorman placed the names and forged signatures of the actual persons onto letters purporting to be from the U.S. Postal Service and the U.S. Federal Trade Commission onto two letters and two certified mail receipts as part of his wire fraud scheme.

Under federal statutes, Gorman is subject to a sentence of up to 20 years in federal prison without parole. The maximum statutory sentence is prescribed by Congress and is provided here for informational purposes, as the sentencing of the defendant will be determined by the court based on the advisory sentencing guidelines and other statutory factors. A sentencing hearing will be scheduled after the completion of a presentence investigation by the United States Probation Office.

As an examiner in training, Gorman did not perform any computer forensic examinations unless under the supervision of a fully certified Heart of America Regional Computer Forensic Laboratory (HARCFL) examiner.

Upon learning of the allegations regarding Gorman, the Heart of America Regional Computer Forensic Laboratory did a complete and thorough review of any cases which Gorman may have assisted in the examination of computer forensic evidence. No inconsistencies, errors or issues were noted with any evidence. The Heart of America Regional Computer Forensic Laboratory is a fully accredited laboratory facility following a strict protocol for the examination of evidence and the training protocol for examiners in training.

This case is being prosecuted by Assistant U.S. Attorney Brent Venneman. It was investigated by the FBI, the U.S. Postal Inspection Service and the U.S. Department of Agriculture, Office of Inspector General – Office of Compliance and Integrity.
