Helping Kids Stay Active and Healthy This Summer

Creative themes and fun games help summer meal sites offer nutrition education and active games.
March is National Nutrition Month. Throughout the month, USDA will be highlighting results of our efforts to improve access to safe, healthy food for all Americans and supporting the health of our next generation.
With summer just around the corner, it’s the perfect time for communities and parents to start thinking about activities for kids when school is out.  With deliciously juicy local fruits and veggies coming into season and, in many areas, warmer weather that invites summer play, it may seem logical that keeping kids healthy would be easier during summer months. However, without the structure of school and afterschool sports, those lazy summer days can sometimes lead to constant snacking and endless hours playing video games and watching TV.
For some children, the summer months can mean food insecurity because they no longer have access to regular school meals. That’s where summer meal programs can help, not only by offering free healthy meals, but also by providing opportunities for nutrition education and physical activity.
New materials developed under USDA’s Team Nutrition initiative include a Take a Healthy Summer Break infographic and This Summer, Eat Smart to Play Hard parent’s guide to provide suggestions for practical ways to keep the whole family healthy during the summer. These are a great resource for schools and community groups to distribute towards the end of the school year.

Team Nutrition also offers an additional Summer Food, Summer Moves kit for summer meal site operators that includes fun activities with positive nutrition messages that can be used in a variety of summer meal settings, from parks to libraries to schools.  The kit also includes posters, family handouts, and a placemat activity sheet.  Enrichment activities, such as providing nutrition education, games and sports, when paired with a healthy meal at summer meal sites, helps children get the nutrition they need.  It can also help kids learn healthy habits they’ll use for life!

WASHINGTON, D.C. – This week, U.S. Sen. Ted Cruz (R-Texas) joined an amicus brief on behalf of 22 members of the Texas congressional delegation in support of private landowners along the Red River. The Bureau of Land Management has recently made waves by claiming thousands of acres of privately owned Texas land along the Red River. It has done so by utilizing—in apparent violation of a nearly 100-year-old Supreme Court precedent and tradition—an arbitrary and bizarre gradient boundary survey method that has adversely impacted private landowners. 
The brief states: “Secure property rights, which are recognized and protected by government, have been and will continue to be vital to our American way of life. The Bureau of Land Management (BLM) has overstepped its constitutional and legal authorities by arbitrarily claiming thousands of privately owned acres of land along the Red River in Texas. The BLM’s incorrect application of the gradient boundary survey method is in violation of the explicit U.S. Supreme Court instructions in Oklahoma v. Texas and runs counter to the long-established responsibility of the federal government to protect the private property rights of its citizens. The BLM’s claim of ownership over Plaintiffs’ private property has caused direct harm to Plaintiffs. The BLM’s failure to delineate with reasonable specificity the unsurveyed Texas lands of which it asserts ownership has clouded the title along the 116-mile contested stretch of the Red River, making it impossible for the Wilbarger, Wichita, and Clay County Plaintiffs and Plaintiff Clay County Sheriff Lemons to carry out legislatively assigned duties and responsibilities. In addition, the BLM’s actions have the possibility of harming private landowners beyond the 116-mile stretch of the Red River if the BLM’s unlawful survey methods are allowed to prevail.”
Sen. John Cornyn (R-Texas) and Rep. Mac Thornberry (R-Texas) joined Cruz in the brief along with Republican Texas U.S. Reps. Kevin Brady, Michael Burgess, John Carter, Mike Conaway, John Culberson, Blake Farenthold, Bill Flores, Louie Gohmert, Kay Granger, Jeb Hensarling, Sam Johnson, Kenny Marchant, Michael McCaul, Randy Neugebauer, Ted Poe, John Ratcliffe, Pete Sessions, Randy Weber, and Roger Williams. The case is Aderholt v. BLM, Civ. Act. No. 7:15-cv-00162-O (N.D. Tex.). 
In June 2014, Sen. Cruz, with Sen. Cornyn and Rep. Thornberry, introduced the Red River Private Property Protection Act to address this issue and direct the BLM to transfer any land in Texas along the Red River to landowners who can prove through official records that they own the land outright.

CORKER: LACK OF UN SECURITY COUNCIL ACTION ON IRAN DEFIES ASSURANCES FROM OBAMA ADMINISTRATION

MEMPHIS, Tenn. – U.S. Senator Bob Corker (R-Tenn.), chairman of the Senate Foreign Relations Committee, today said the U.N. Security Council’s refusal to hold Iran accountable defies the Obama administration’s assurances that a ban on Tehran’s ability to test ballistic missiles would remain in place after implementation of the Iran nuclear deal this January. Diplomats cited in a Reuters reporttoday suggest that Iran’s repeated ballistic missile tests do not technically violate provisions of U.N. Security Council Resolution (UNSCR) 2231, which was adopted last July to enforce the Iran nuclear agreement.
“The implication that Iran’s ballistic tests do not violate the U.N. resolution and therefore do not justify U.N. Security Council action directly contradicts assurances made by the administration last year when it promised that restrictions would remain in place,” said Corker, who voted against lifting sanctions on Iran to implement the nuclear deal. “As many of us feared, now it appears Iran can defy those restrictions with impunity fearing no pushback from the U.N. Security Council. There is also bipartisan concern with the administration’s refusal to impose tougher penalties on Iran for these and other illicit activities.”
UNSCR 2231 states that Iran is “called upon” not to engage in ballistic missile activities for up to eight years, a lower bar than previous resolutions demanding that Iran “shall not” engage in such actions. Asked to interpret the implications of the new language in testimony before the Senate Foreign Relations Committee last December, U.S. Ambassador Stephen Mull, the lead coordinator for U.S. implementation of the Joint Comprehensive Plan of Action (JCPOA), assured senators that Iranian ballistic missile activities would still “violate that part of the U.N. Security Council resolution”.
U.S. Secretary of State John Kerry was even more definitive earlier in July when he disputed that the language associated with the ballistic missile ban had been altered in the new resolution. “The exact same language that is in the embargo is in the agreement with respect to [missile] launches,” he said.

Bonita Springs Man Sentenced To 8 Years In Federal Prison For Distributing Child Pornography

Fort Myers, Florida – U.S. District Judge John E. Steele has sentenced Christopher Hall (45, Bonita Springs) to eight years in federal prison for distributing child pornography. The Court also ordered him to forfeit the computers he had used to commit the offense. Hall pleaded guilty on November 30, 2015. 
According to court documents, on May 9, 2014, an undercover FBI Task Force agent discovered that Hall was sharing child pornography using a peer-to-peer file sharing network. A federal search warrant was then executed at Hall’s residence and his computers were seized. Forensic analyses subsequently revealed more than 2,500 images of child pornography and 9 videos depicting child pornography on those computers. Hall admitted that he had lived alone and was the only person who had used his computers, and that he never shared his secured Internet connection with anyone. He stated that he began downloading child pornography ten years ago.
This case was investigated by the Federal Bureau of Investigation, FBI Child Exploitation Task Force.  It was prosecuted by Assistant United States Attorney Charles D. Schmitz.
This case was brought as part of Project Safe Childhood, a nationwide initiative launched in May 2006 by the Department of Justice to combat the growing epidemic of child sexual exploitation and abuse.  Led by United States Attorneys' Offices and the Criminal Division's Child Exploitation and Obscenity Section (CEOS), Project Safe Childhood marshals federal, state, and local resources to locate, apprehend, and prosecute individuals who sexually exploit children, and to identify and rescue victims.  For more information about Project Safe Childhood, please visit www.justice.gov/psc.

Colombian Man Pleads Guilty To Drug Charge

Tampa, Florida – United States Attorney A. Lee Bentley, III announces that Anderson Bryan Lever (39, Colombia, South America) today pleaded guilty to conspiring with others to distribute five kilograms or more of cocaine on board a vessel subject to the jurisdiction of the United States. He faces a mandatory minimum penalty of 10 years, up to life, in federal prison.
According to the plea agreement, on multiple occasions between 2009 and 2013, Lever worked with others to smuggle cocaine into the United States. He repeatedly dispatched cocaine-laden vessels, carrying between 550 and 1,000 kilograms of cocaine, from San Andres Island (SAI), Colombia to Honduras. On each occasion, Lever recruited and paid at least four mariners per vessel. 
Lever’s co-conspirators received the cocaine shipments in Honduras and then provided bales of United States currency (containing as much as $500,000 each) to the mariners who had just smuggled the cocaine. The mariners then smuggled the money back to Lever, and the cocaine was transferred to others for eventual unlawful importation into the United States. In total, the mariners Lever hired Lever successfully smuggled in excess of 10,000 kilograms of cocaine.
Lever was arrested on SAI, Colombia, and subsequently extradited to the United States.
This case was investigated by the Panama Express Strike Force, a standing Organized Crime Drug Enforcement Task Force (OCDETF) investigation, comprised of agents and analysts from the Federal Bureau of Investigation, U.S. Immigration and Customs Enforcement’s Homeland Security Investigations, the Drug Enforcement Administration, the United States Coast Guard Investigative Service, the Naval Criminal Investigative Service, and U.S. Southern Command's Joint Interagency Task Force South.  The principal mission of the OCDETF program is to identify, disrupt, and dismantle the most serious drug trafficking and money laundering organizations and those primarily responsible for the nation’s drug supply. This case is being prosecuted by Assistant United States Attorney Christopher F. Murray. The Office of International Affairs, Department of Justice, assisted with Lever’s extradition from Colombia.

Pasco County, Florida, Man Sentenced to Prison for Cross Burning

The Justice Department announced that Pascual Carlos Pietri, 53, of Port Richey, Florida, was sentenced to 37 months in prison by U.S. District Judge Susan C. Bucklew of the Middle District of Florida for his role in a 2012 cross burning.  He pleaded guilty on June 30, 2015, to one count of conspiring with others to threaten, intimidate and interfere with an interracial couple’s enjoyment of their housing rights.
“Those who violently threaten others because of racial differences tear at the very fabric of our diverse American society,” said Principal Deputy Assistant Attorney General Vanita Gupta, head of the Justice Department’s Civil Rights Division.  “The laws that protect our society leave no place for hate crimes.”
“Cross burning remains a vicious symbol of hatred,” said U.S. Attorney A. Lee Bentley III.  “All American families have the right to live where they choose, undisturbed by such racist threats. This prosecution sends a clear message that we will not tolerate hate crimes in our community.”
According to court documents, on Oct. 31, 2012, Pietri was living with another individual on Seward Drive in Port Richey in a predominantly white community.  After an interracial couple moved next door, Pietri heard other neighbors make racial slurs and derogatory statements about African-Americans in general, and specifically the African-American neighbor.
On Halloween night, Pietri attended a party at a neighbor’s house, where several Seward Drive residents decided to burn a cross in the African-American man’s yard to intimidate him.  Using wood and tools from the host of the Halloween party, Pietri’s co-conspirators constructed a wooden cross and obtained gasoline to pour on the cross.  Pietri and a co-conspirator then carried the cross to the victims’ front yard, leaned it against their mailbox and set the cross on fire.  Pietri and the co-conspirators burned the cross in the victims’ yard in an effort to intimidate the interracial couple.
This case was investigated by the FBI.  It was prosecuted by Assistant U.S. Attorneys Josephine W. Thomas and Simon A. Gaugush of the Middle District of Florida, and Trial Attorney William E. Nolan of the Civil Rights Division’s Criminal Section.

SAN FRANCISCO – Robert Spence II was sentenced yesterday to ten years in prison for possession of child pornography, announced Acting United States Attorney Brian J. Stretch and Federal Bureau of Investigation Special Agent in Charge David J. Johnson.
Spence, 66, of Pacifica, pleaded guilty on December 1, 2015, to one count of possession of pornography depicting minors under the age of 12 engaging in sexually explicit conduct.  According to his guilty plea, Spence acknowledged that, beginning no later than September 15, 2013, he communicated with individuals in the Philippines to obtain child pornography.  Papers filed by the government reveal that a search warrant executed by FBI agents and Pacifica Police Department officers at Spence’s home found more than 1,200 images and videos of child pornography, including images depicting the sexual abuse of children as young as three and four years old.  A federal grand jury indicted Spence on June 2, 2015, with possession of child pornography, in violation of 18 U.S.C. § 2252(a)(4)(B). 
The sentence was handed down by the Honorable Vince Chhabria, U.S. District Judge.  Judge Chhabria concluded that, because defendant had sustained prior convictions for sexual battery pursuant to California Penal Code § 243.4(a), he was subject to the mandatory minimum ten year term of imprisonment in 18 U.S.C. § 2252(b)(2).  Spence has been ordered to self-surrender to begin serving his sentence no later than May 5, 2016.  Judge Chhabria also imposed a seven year period of supervised release.
Assistant U.S. Attorney Sheila A.G. Armbrust prosecuted the case with the assistance of Patricia Mahoney.  The prosecution is the result of an investigation by the Pacifica Police Department and the Federal Bureau of Investigation.

Former Joint Powers Authority Finance Director Sentenced To A Year In Prison And Six Months Home Confinement

Former Employee of Association of Bay Area Governments Embezzled Nearly $3.9 Million

SAN FRANCISCO– Clarke J. Howatt was sentenced today to a year and a day in prison for his conviction for wire fraud stemming from a series of embezzlements from the Association of Bay Area Governments (ABAG) and the related ABAG Finance Authority for Nonprofit Corporations (FAN), announced Acting United States Attorney Brian J. Stretch and Federal Bureau of Investigation Special Agent in Charge David J. Johnson.
Howatt, 56, who now resides in Portland, Ore., pleaded guilty on December 15, 2015, to committing wire fraud.  In connection with his plea agreement, Howatt acknowledged perpetrating a scheme to embezzle funds from various bond accounts and other accounts established by FAN.  Howatt is the former finance director of ABAG, a state Joint Powers Agency formed in the 1960s for the principal purpose of providing its members with planning and advice regarding land use issues.  FAN was formed as a separate legal entity to act as a conduit issuer of debt instruments, or bonds. As part of his plea agreement, Howatt admitted he provided false information to the trustees of bond accounts and to others in order to fraudulently induce people to wire funds from FAN bond accounts and other accounts, to bank accounts that Howatt controlled.  Howatt admitted that from June 2011 through January 2015, he embezzled a total of $3,876,135.21.  Howatt, was charged in an information filed on February 13, 2015, with the single count of wire fraud, in violation of 18 U.S.C. § 1343, and pleaded guilty to that charge.
The sentence was handed down by the Honorable Charles R. Breyer, U.S. District Judge.  In addition to the prison term, Judge Breyer also sentenced the defendant to a three year period of supervised release, six months of which will be served in home confinement.  Howatt will begin serving the sentence no later than May 23, 2016.
Assistant U.S. Attorneys Kyle Waldinger and David Countryman are prosecuting the case with the assistance of Jessica Meegan and Carolyn Jusay.  The prosecution is the result of an investigation by the FBI.

Applications are now being accepted for FBI San Diego’s 2016 Teen Academy, which will take place on June 29, 2016 and August 17, 2016 at the San Diego Field Office headquarters in Sorrento Valley. Any student interested in the FBI, what we do, and how a relationship with the FBI can help his or her school and community is encouraged to apply. The Teen Academy is open to high school sophomores or juniors enrolled in a public, private, charter, or home school program. The applicant must currently attend school within San Diego County or Imperial County to be eligible to apply.
Students selected for the FBI Teen Academy spend an interactive day with special agents and professional staff participating in both classroom and hands-on activities. Classes will offer an insider’s look into criminal and cyber investigations and hands-on experience involving evidence collection and tactical operations, all while learning about the FBI’s core values. After completing the class, students will be more aware of the challenges their communities face and better understand how the FBI serves their community. Teen Academy graduates are encouraged to mentor their peers by sharing the knowledge they have gained through the program.
The FBI’s Teen Academy application process allows for the identification of a diverse pool of students who are capable of leadership and have an interest in the FBI. An essay is required of all applicants. The essay will be the first element of the application package that will be reviewed and provides an insight into the student’s motivations for attending. All applications should highlight the student’s school activities and community involvement, which will be an important part of the criteria used to evaluate the applicants

Shoshone Man Sentenced to 130 Years for Producing Child Pornography

Idaho Man Convicted at October 2015 Trial of Three Counts of Sexual Exploitation of a Minor, One Count of Possession of Child Pornography, and One Count of Access with Intent to View Child Pornography

BOISE –William Roger Wilkinson, 54, of Shoshone, Idaho, was sentenced today to 130 years in federal prison for sexually exploiting an eight-year-old child on three occasions by using her to produce sexually explicit images, possessing child pornography and accessing child pornography with intent to view, U.S. Attorney Wendy Olson announced.  Chief U.S. District Judge B. Lynn Winmill also sentenced Wilkinson to a term of supervised release of five years, and entered an order forfeiting Wilkinson's interest in his former Shoshone home and real property where the child pornography was produced, and the electronic equipment used to commit the offenses.  The proceeds of the forfeiture will be used to satisfy the Court's order of restitution to the victims of the offenses, which totals $155,766.36.  Wilkinson was convicted by a jury on October 29, 2015, after a five-day trial.        
According to the evidence presented at trial, the investigation began in May 2013, after an eight-year-old child disclosed that Wilkinson had taken sexually explicit pictures of her.  Lincoln County Sheriff’s deputies arrested Wilkinson in May 2013, and searched his home in Shoshone, Idaho.  During the investigation, Wilkinson was released on bond, but a warrant was issued for his arrest after the investigation revealed child pornography on a desktop computer taken from his residence.  Wilkinson fled his place of work in Twin Falls, Idaho, when deputies attempted to arrest him on November 2, 2013.  The United States Marshal’s Service Fugitive Task Force in Salt Lake City, Utah, arrested Wilkinson on November 12, 2013.  The FBI obtained a warrant to search the truck Wilkinson had driven to Utah and found a laptop computer and other evidence. 
A forensic examiner from the FBI’s Intermountain West Regional Computer Forensics Lab located images on both the desktop computer and the laptop computer depicting Wilkinson and the eight-year-old child engaging in sexually explicit conduct.  That evidence showed that on November 3, 2012, on December 9, 2012, and on March 3, 2013, Wilkinson knowingly used, persuaded, or coerced an eight-year-old child to take part in sexually explicit conduct and produced visual depictions of that conduct.   Data imbedded in the digital photos showed that they were taken at Wilkinson’s home in Shoshone, Idaho.   The evidence further showed that Wilkinson searched for, and viewed, websites containing child pornography on his desktop computer.           
"Appropriately, Mr. Wilkinson will spend the rest of his life in federal prison, where he can no longer directly harm his young victim or pose any further threat to children," said Olson.  "This sentence sends the strong and clear message that those who prey on the most vulnerable among us will face sure and stern punishment."
The case was investigated by agents from the Federal Bureau of Investigation in Idaho and Utah, and deputies from the Lincoln County, Idaho, Sheriff’s Department and the United States Marshals Service.
