“Last election, the American people chose a new direction with a new Republican majority in Congress.
“We’ve been working hard ever since to get Congress back on their side and back to work.

“Americans have seen committees up and running again.
“Americans have seen bills passing again.
“Americans have seen meaningful, bipartisan bills being signed into law again.
“Americans have also seen members of opposing parties working together to make progress on important issues.
“From trade to Medicare to cybersecurity, we’ve seen examples of it this year on some of Washington’s stickiest issues.
“We saw the Senate pass a bipartisan, multi-year highway bill this summer, 65 to 34.
“The Republican Chairman and Democrat Ranking Members worked closely to bring this about.
“We also saw the Senate pass a bipartisan replacement for the broken No Child Left Behind law this summer, 81 to 17.
“I’d like to thank Sen. Alexander and Sen. Murray for working closely across the aisle on that achievement.
“These represent significant accomplishments for the new Congress and significant wins for the American people. After all, some pundits said Washington could never take these issues on at all.

WASHINGTON, D.C. – U.S. Senate Majority Leader Mitch McConnell made the following remarks on the Senate floor today regarding the President’s costly power plan:
“When President Obama tried to push a regressive, anti-Middle Class energy tax through a Democrat-controlled Congress, his own party said no.
“Undeterred, the President simply went around Congress to impose similarly regressive — and likely illegal — ‘power plan’ energy regulations anyway.
“He’s currently trying to sell that power plan to world leaders in Paris as proof of the American government’s commitment to his energy priorities. But with all due respect to the President as our Commander in Chief, governments currently engaged in this round of climate talks will want to know that there is more than just an Executive Branch in our system of government.
“More than half of the states have filed suit against the President’s power plan.
“A bipartisan majority in both chambers of Congress has approved legislation that rejects it.
“The courts appear likely to strike it down.
“And the next president could simply tear it up.
“This is the easily foreseeable result of intentionally sidestepping Congress to impose this anti-Middle Class power plan. If left in place, the power plan threatens to punish the poor and could result in the elimination of as many as a quarter million U.S. jobs.
“For what?
“The power plan won’t even meaningfully affect global carbon emissions, and could actually increase emissions by offshoring American manufacturing to countries that lack our environmental standards.
“Pain for the Middle Class, a climate rounding error for negotiators in Paris.
“That’s not a good policy for America’s working families. That’s not a good policy for our country. It certainly wouldn’t be responsible to attempt to negotiate commitments based upon a likely-illegal power plan — one that may not even survive much longer anyway.”

FORT MYERS, FL—United States Attorney A. Lee Bentley, III announces the return by a federal grand jury of indictments charging Edrey Santo Rojas (30) and Henry Alberto Fernandez Gomez (29), both of Cape Coral, with credit card fraud and aggravated identity theft. Rojas is also charged with possession of a credit card skimming device. If convicted on all counts, each faces up to 10 years in federal prison for the credit card fraud and a consecutive term of two years for each aggravated identity theft charge. Rojas also faces up to 15 years’ imprisonment for possession of the credit card skimming device.
According to the indictment, on or about May 23, 2014, in Lee County, Rojas possessed, with intent to defraud, a credit card skimmer. The indictment also alleges that between December 9, 2014, and August 8, 2015, he used one or more credit card numbers assigned to another person, without permission, to obtain something of value in excess of $1,000. Rojas also used three counterfeit and unauthorized access devices with account numbers belonging to financial institutions and individuals.
According to a separate indictment, between December 30, 2014, and April 13, 2015, Fernandez Gomez used one or more credit card numbers assigned to another person, without permission, to obtain something of value in excess of $1,000. He also used counterfeit and unauthorized access devices with account numbers belonging to financial institutions and individuals, without lawful authority.
An indictment is merely a formal charge that a defendant has violated one or more federal criminal laws, and every defendant is presumed innocent unless, and until, proven guilty.
This case was investigated by the Federal Bureau of Investigation, the Lee County Sheriff’s Office and the Cape Coral Police Department, with assistance from the United States Secret Service and the State Attorney’s Office, 20th Judicial Circuit. It will be prosecuted by Assistant United States Attorney David G. Lazarus.

The FBI reminds shoppers at the start of this holiday shopping season to beware of cyber criminals and their aggressive and creative ways to steal money and personal information. Scammers use many techniques to defraud consumers by offering too-good-to-be-true deals via phishing e-mails advertising brand name merchandise, quick money-making offers, or gift cards as an incentive to purchase a product. Remember, if the deal looks too good to be true, it probably is and never provide your personal information to an unknown party or untrusted website.
Scammers often use e-mail to advertise hot-ticket items of the year that may become hard to find during the holidays to lure unsuspecting consumers to click on links. Steer clear of untrusted sites or ads offering items at unrealistic discounts or with special coupons. You may end up paying for an item, giving away personal information and credit card details, and then receive nothing in return, along with your identity compromised. These sites may also be offering products at a great price, but the products being sold are not the same as the products they advertise. This is known as the bait and switch scam.
Beware of posts on social media sites that appear to offer vouchers or gift cards, especially sites offering deals too good to be true, such as a free $500 gift card. Some may pose as holiday promotions or contests. It may even appear one of your friends shared the link with you. If so, it is likely your friend was duped by the scam after it was sent to them by one of their friends. Oftentimes, these scams lead to online surveys designed to steal personal information. Remember, if the deal looks too good to be true, it probably is. And never provide your personal information to an unknown party or untrusted website.
When purchasing gift cards online, be leery of auction sites selling discounted or bulk offers of gift cards. When purchasing gift cards in the store, examine the protective scratch off area on the back of the card to see if it has been tampered with.
Be on the lookout for mobile applications designed to steal your personal information from your smartphone. Such apps are often disguised as games and are often offered for free. Research the company selling or giving away the app and look online for third party reviews before installing an app from an unknown source.
Tickets to theater, concerts, and sporting events are always popular gifts during the holidays. If you purchase or receive tickets as a gift, do not post pictures of the tickets to social media sites. Protect the barcodes on tickets as you would your credit card number. Fraudsters will create a ticket using the barcode obtained from searching around social media sites and resell the ticket. You should never allow the barcode to be seen on social media.
If you are in need of extra cash at this time of year, beware of sites and posts offering work you can do from the comfort of your own home. Often, the work from home opportunities rely on convenience as a selling point for applicants with an unscrupulous motivation behind the posting. You should carefully research the job posting and individuals or company contacting you for employment.
As a consumer, if you feel you are a victim of an Internet-related crime, you may file a complaint with the FBI’s Internet Crime Complaint Center at www.IC3.gov.
Tips
Here are some additional tips you can use to avoid becoming a victim of cyber fraud:
  • Check your credit card statement routinely.
  • Protect your credit card numbers from “wandering eyes”.
  • Do not respond to unsolicited (spam) e-mail.
  • Do not click on links contained within an unsolicited e-mail.
  • Be cautious of e-mail claiming to contain pictures in attached files, as the files may contain viruses. Only open attachments from known senders. Scan the attachments for viruses if possible.
  • Avoid filling out forms contained in e-mail messages that ask for personal information.
  • Always compare the link in the e-mail to the link you are actually directed to and determine if they actually match and lead you to a legitimate site.
  • Log on directly to the official website for the business identified in the e-mail, instead of “linking” to it from an unsolicited e-mail. If the e-mail appears to be from your bank, credit card issuer, or other company you deal with frequently, your statements or official correspondence from the business will provide the proper contact information.
  • If you are requested to act quickly or there is an emergency, it may be a scam. Fraudsters create a sense of urgency to get you to act quickly.
  • Verify any requests for personal information from any business or financial institution by contacting them using the main contact information on their official website.

SAN DIEGO—Todd Bosnich, fired policy director for the failed Carl DeMaio congressional campaign, was sentenced today to five years of probation for sending anonymous e-mails to himself—making it appear that DeMaio threatened him—and then lying to the FBI about it.
U.S. District Judge Larry Burns also ordered Bosnich to undergo psychiatric counseling, complete 240 hours of community service and a pay a $2,500 fine. In imposing the sentence, Judge Burns noted that DeMaio lost the election.
“There is no way of knowing how much [Bosnich’s conduct] effected voters’ minds,” he said, emphasizing that this was not a victimless crime. “The victim is Mr. DeMaio, DeMaio’s campaign, or the democratic process.”
Bosnich pleaded guilty in June, admitting that he instigated and impeded the FBI investigation. According to his plea agreement, after he was terminated from his job in May of 2014, a disgruntled Bosnich made sexual harassment accusations against DeMaio. Among other things, he claimed that DeMaio offered him $50,000 in hush money to keep quiet about the harassment.
Bosnich also told a radio reporter during an interview on June 2, 2014 that he had received threatening e-mails from an anonymous source that he was “positive” were from DeMaio or someone closely associated with DeMaio.
According to his plea agreement, Bosnich admitted that three days later, on June 5, 2014, Bosnich set up a dummy yahoo e-mail account, elimanagment@yahoo.com, from his North County residence using bogus personal information including a false date of birth and gender. According to his admissions, he then sent a “particularly ugly and threatening message” to his own personal e-mail account. The e-mail suggested that the “anonymous” author of the e-mail would ensure that Bosnich never again worked in politics if he didn’t stop making accusations against DeMaio.
During multiple interviews with the FBI, Bosnich—supposedly the victim of threatening e-mails—continued to claim that he did not know who sent the e-mails, but he believed DeMaio was behind the anonymous threats. Based on these false claims, a grand jury issued subpoenas attempting to identify the source of the e-mails. All the while, it was Bosnich himself who had sent the e-mails.
“The integrity of the American electoral process is the very bedrock of our democracy,” said U.S. Attorney Laura E. Duffy. “Bosnich’s criminal act had the very real possibility of improperly tipping the scale towards a particular candidate. This was far from a harmless prank.”
“Mr. Bosnich engaged in a pattern of lies and deceitful acts in an effort to obstruct FBI Agents from getting to the truth in this case,” said FBI Special Agent in Charge Eric S. Birnbaum. “Today’s sentencing sends a clear message that the FBI will aggressively investigate and seek prosecution of those who attempt to obstruct justice by lying to the FBI.”

Pain Doctor Indicted on Federal Drug Charges

BECKLEY, WV—United States Attorney Booth Goodwin announced today that Dr. Jose Jorge Abbud Gordinho, M.D., was indicted on multiple federal drug charges by a Grand Jury sitting in Beckley, West Virginia. Gordinho was arrested on November 12, 2015, at which time the West Virginia State Police and the Federal Bureau of Investigation executed a search warrant at his medical office on George Street in Beckley. Gordinho has been held in custody in the Southern Regional Jail since the date of his arrest.
The 21 count indictment includes allegations that Gordinho conspired to distribute pain medications such as oxycodone and morphine, not for legitimate medical purposes in the usual course of medical practice and beyond the bounds of medical practice. The indictment further alleges multiple counts of distribution of oxycodone, oxymorphone, hydrocodone, and morphine not for legitimate medical purposes in the usual course of medical practice and beyond the bounds of medical practice, as well as two counts of distributing controlled substances not within Gordinho’s capacity as a medical doctor.
Each of the 21 counts carries a maximum sentence of up to 20 years in federal prison and a $1 million fine. Gordinho is scheduled to be arraigned on the indictment on November 30, 2015, in federal court in Beckley. At that time, the court will also consider a motion filed by the United States to detain Gordinho pending his trial.
The charges are merely accusations. The defendant is presumed innocent until and unless proven guilty.
The case against Gordinho was investigated by the West Virginia State Police and the Federal Bureau of Investigation.
This case is being prosecuted as part of an ongoing effort led by the United States Attorney’s Office for the Southern District of West Virginia to combat the illicit sale and misuse of prescription drugs and heroin. The U.S. Attorney’s Office, joined by federal, state and local law enforcement agencies, is committed to aggressively pursuing and shutting down illegal pill trafficking, eliminating open air drug markets, and curtailing the spread of opiate painkillers and heroin in communities across the Southern District.
